Tube Your Own Horn (“TYOH”) Program offers you the opportunity to invest in yourself and your personal development with our materials, your practice, and shared live access to Dan Lok.
As a TYOH Student (“You”), you will pay an upfront fee of either $1,995 USD or three (3) monthly payments of $795 USD. When you purchase TYOH, you get a limited license from us to access and use our sites, our materials and content, and services for personal use. This license is revocable at any time, in sole our discretion, as all materials and content created by us are owned by us. You retain ownership of content you post to our sites.
TYOH program is offered by Emperor Commercial Properties, Inc. (“ECP”) whose registered office is at Suite 202 – 2232, West 41st Avenue, Vancouver BC, V6M 1Z8, Canada. As used herein, the term “ECP” refers to ECP and any of its successors, assignees, transferees, subsidiaries, parent and associate corporations, or affiliates.
Due to the nature of our services, which include: downloadable videos, digital documents, tools, and/or streaming videos, online memberships and subscriptions, live events, and client interactions (both online and face-to-face), unless otherwise stated by TYOH, all fees payable and due are non-refundable.
If you joined TYOH Program by paying an upfront fee of $1,995 USD, you may request a refund at any time up until the commencement of the third class of the TYOH program and receive a full refund. Cancellation requests received after commencement of the third class of a given season will not be eligible for a refund.
If you joined TYOH Program using our payment plan of 3 monthly instalments of $795 USD, you may request a refund at any time up until the commencement of the third class of the TYOH program. We will refund the amounts received from you and release you from payment obligations under future unbilled instalments if any. Cancellation requests received after commencement of the third class of a given season will not be eligible for a refund. However, if you request to cancel after the commencement of the third class and before the commencement of the 6th class of the TYOH program, we will revoke your access to TYOH and release you from future unbilled instalments, if any.
Cancellation and refund requests must be sent by email to support@danlok.com. You may not attend any classes or otherwise receive any TYOH services after you make your cancellation request. Doing so will render your cancellation request null and void.
TYOH may terminate your subscription, without notice and in its sole discretion, if you misuse TYOH’s intellectual property and content, exhibit prohibited uses and behaviours (such as defaming or attempting to defame another person or institution), or breach TYOH’s policies and/or rules.
Students who have not gone through the entire program or fully met their payment obligations will not receive their graduation certificate.
Show respect . . .
You are responsible for all the content that you post in our discussion groups. You should keep the reviews, questions, posts, and any other content you upload respectful of others, including ECP, respectful to the intellectual property right of others, and not facilitate the distribution of information or content that is unlawful, misleading, fraudulent, or for an illegal or unauthorized purpose. We, in our sole discretion, may suspend or terminate your subscription for repeated or major offences or remove any content that does not comply with: (i) these terms; (ii) TYOH’s policies and rules; or (iii) is otherwise harmful, objectionable, inaccurate, or unlawful.
And finally . . .
You agree that by registering, accessing or using our services, you are agreeing to enter into a legally binding contract with ECP. If you do not agree to these terms, do not register, access, or otherwise use any of our services.
We (and our successors, assignees, transferees, subsidiaries, parent and associate corporations, affiliates, divisions, principals, administrators, directors, officers, board members, agents, employees, contractors, instructors, and insurers) make no warranty that you will obtain specific results from use of the services. Your use of the services (including any content) is entirely at your own risk.
If you behave in a way that gets us in legal trouble, we may seek legal recourse against you. You agree to indemnify, defend (if we so request), and hold harmless ECP, and our successors, assignees, transferees, subsidiaries, parent and associate corporations, affiliates, divisions, principals, administrators, directors, officers, board members, agents, employees, contractors, instructors, and insurers from and against any third-party claims, demands, losses, damages, or expenses (including reasonable attorney fees) arising from (a) the content you post or submit, (b) your use of the services (c) your violation of these terms, or (d) your violation of any rights of a third-party. Your indemnification obligation will survive the termination of these terms and your use of the services.
You agree that no joint venture, partnership, employment, contractor, or agency relationship exists between us.
If any part of these terms is found to be invalid or unenforceable by applicable law, then that provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these terms will continue in effect.
Even if we are delayed in exercising our rights or fail to exercise a right in one case, it doesn’t mean we waive our rights under these terms, and we may decide to enforce them in the future. If we decide to waive any of our rights in a particular instance, it doesn’t mean we waive our rights generally or in the future.
From time to time, we may update these terms to clarify our practices or to reflect new or different practices (such as when we add new features), and TYOH reserves the right in its sole discretion to modify and/or make changes to these terms at any time. If we make any material change, we will notify you using prominent means such as by email notice sent to the email address specified in your account or by posting a notice through our services. Modifications will become effective on the day they are posted unless stated otherwise.
Your continued use of our services after changes become effective shall mean that you accept those changes. Any revised terms shall supersede all previous terms.
